Terms of Service | Markwise

Markwise is operated by Reaktif LLC, a limited liability company organised under the laws of the State of Delaware, United States. The founder is resident in the United Kingdom. "We", "us", and "our" mean Reaktif LLC.

These terms cover markwise.app, the Chrome extension, and the iOS app (together, the "service"). By using the service you agree to them. If you do not agree, do not use it.

The service

Markwise lets you save bookmarks, notes, highlights, and YouTube timestamps, file them into Spaces, search them, and (on Pro) ask Copilot questions about your own library.

We do not promise that search, summaries, or Copilot answers are complete or correct. AI output can be wrong. You are responsible for how you use what you saved and what the model returns.

The current Free and Pro limits are on the pricing section of markwise.app. We may change limits. If a paid limit change is material, we will give notice before it applies to an existing paid period.

Eligibility

You must be at least 13. If you are under 18 you may use the service only with a parent or guardian's permission.

Keep your credentials to yourself. Email/password accounts store a hashed password. Google sign-in is optional. See the Privacy Policy for how account data is handled.

Your content

You keep ownership of the URLs, notes, highlights, and other material you save ("your content").

You grant us a licence to host, process, embed, summarise, and display your content as needed to run the service, including sending it to our language-model provider. That licence ends when you delete the content or the account, except for backups and legal holds that we then drop.

You are responsible for your content. Do not save material you have no right to store, and do not use the service to break the law.

Spaces are private until you make one public. A public Space can be viewed by anyone with the link and may appear on /explore. Unpublish it if that was a mistake.

Acceptable use

You agree not to:

Probe, scrape, or overload the API beyond normal product use
Bypass Free-plan limits, paywalls, or rate limits
Resell or white-label the service without a written agreement with Reaktif LLC
Use Copilot or exports to build a competing library product from other people's content
Upload malware or attempt to access another account
Use the service if doing so would violate the law where you live

We may suspend or close an account that we reasonably believe is breaking these terms.

Plans, trial, and billing

Web Pro is billed by Stripe. First-time web subscribers get a 3-day trial. A card is required for the trial. You are not charged until the trial ends. Cancel before then and you are not charged.

iOS Pro is billed by Apple under Apple's terms. Manage or refund iOS purchases through your Apple ID. We cannot issue App Store refunds from markwise.app.

Subscriptions renew until you cancel. Cancel from Settings on the web (Stripe portal) or from Apple subscriptions on iOS. Access continues through the end of the period you already paid for.

You can pause a paying web subscription once, for 30 days. Trials cannot be paused. After that, cancel or keep paying.

Prices are shown in US dollars. Taxes may be added where the law requires. We do not automatically collect VAT in every country. If that changes, the checkout price will say so.

We may change prices. We will email you before a new price hits a renewal. Cancel before that renewal if you do not accept it.

Refunds

There is no 30-day money-back guarantee. An older version of these terms said there was. That was wrong.

Web trial: cancel during the 3 days and you pay nothing
After a paid charge: we do not pro-rate unused days
If the service was down for a long stretch in a paid period, email [email protected] and we will consider a credit or refund
iOS: refunds are Apple's decision
UK consumers: the 14-day distance-selling right for digital services applies, subject to the usual exceptions (starting to use the service during that window can waive it). Nothing here limits statutory rights

AI

Summaries, tags, embeddings, and Copilot answers are generated by a language model. They can omit sources, invent details, or miss the point of what you saved. Do not treat them as legal, medical, or financial advice.

Our IP

The Markwise name, UI, extension, and software are ours. You may not copy the product, scrape the marketing site for a clone, or remove our marks from the app.

Termination

You can close the account from Settings. That deletes the library we hold for you, subject to backups we then drop and billing records we must keep.

We may suspend or terminate access if you breach these terms, if we have to for law or security, or if we shut the product down. If we shut it down we will try to give notice and a chance to export.

Liability

The service is provided "as is". To the maximum extent the law allows, we disclaim implied warranties.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, lost data, or lost library content, except where the law says we cannot exclude that.

Our total liability for a claim is capped at the greater of the fees you paid us in the 12 months before the claim, or US$100.

Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited as a matter of law.

Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.

If you are a UK consumer, mandatory consumer-protection rules of your country of residence still apply and override anything inconsistent here. UK residents may bring consumer claims in the courts of England and Wales.

Any non-consumer dispute will be resolved in the state or federal courts located in Delaware.

Changes

We may update these terms. The "Last updated" date on this page will change. Material changes will be announced on the service or by email at least 14 days before they take effect. Continued use after that date is acceptance.
